I traded in my car about a week ago, and the dealership has not paid off my previous loan yet. I was wondering how long it typically takes.

It may depend when they cut the checks. A small dealership may only have 1 person who does the accounting and it may take he/she a week or two. I think that leagally you are okay and that they assumed the loan under the contracts you signed when you bought your new car. I have bought about 10 cars from dealership and it seems that it takes about two weeks.

Question by Elle08: How long does a CA. car dealership have to trasfer over a title?
I bought a car at a big dealership in CA in Dec. 06. Currently, I am still waiting on new tags because the dealership has yet to recieve the title from the previous owner’s bank. My bank is still waiting on the title, and recently, I have refinanced with a new bank who is also waiting on the title. My question is, I have waited almost 5 months for my registration, is what the dealership doing legal? I have called and visited the dealership many times, and each time the only answer I get is that they’re still trying to call the bank. Is it legal for a CA dealership to sell me a car they don’t have the title to? What can I do to speed the process (I plan on moving out of state in Jun)? What will happen when I do move? Should I get a lawyer involved? Thank you.

It is the California DMV that issues vehicle registrations and titles in the state, as well as maintaining the official vehicle ownership and registration records in California.
Beyond establishing the legally registered owner during the sale of a vehicle, the California DMV also takes on the responsibility of regulating and issuing the decals, or tags, that prove that a California vehicle’s registration and paperwork are current. Registration renewals require proof of financial liability, most often in the form of adequate auto insurance.
To be issued a new title in your name, you’ll need to visit your local DMV office. For shorter lines, first make an appointment. Bring with you:
California Certificate of Title OR Request for Duplicate Title. Either must be endorsed by the buyer, seller, and any lienholder.
Odometer disclosure for cars less than 10 years old (there is space for this on the title).
Smog certificate (if applicable).
All applicable fees, including a title transfer fee.
You should have received it before the 21 day temporary ran out. This might just be an error by the dealer…call them and ask. If you cant get it straightened out with them, call you nearest dmv office and they can help you.

I have had the car almost 2 months, and the still keep getting denial letters from banks in the mail. I contacted the dealership, and they say they are still working on getting me financed. The car has been at the dealership for the last 3 weeks because it is defective and they are fixing it. For them to take so long to get me financed seems outragious to me and they are making my credit worse because of the denials. Legally, in california, how long do they have to get me financed and can i cancel the contract?

They sound fishy, but why wouldn’t you get financing BEFORE getting a car? I would imagine they are keeping the car because it isn’t yours yet – it is still theirs, no?
Get financing first, then pick out a car you can reasonably afford!
